TERMS OF SERVICE

Last updated: July 8, 2026

1. Acceptance of Terms

By accessing our website or engaging Sunshower Collective's services, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Description of Services

Sunshower Collective provides coaching and consulting services across four frameworks: Wellness Practice Consulting, Wellness Business & Entrepreneur Consulting, Burnout Recovery Coaching, and TCM-Informed Wellness Coaching.

These services are educational, strategic, and personal-development in nature. They are not therapy, medical treatment, or licensed clinical care, and are not a substitute for such care. Sunshower Collective does not provide legal or financial advice.

Sunshower Collective's founder, Dr. Kat Thigpen, is a licensed acupuncturist and holds a Doctor of Acupuncture and Chinese Medicine (DACM). However, services provided through Sunshower Collective are coaching and consulting services only. They do not constitute the practice of acupuncture, Traditional Chinese Medicine, or any other licensed clinical or medical service, and no clinician-patient relationship is formed through this engagement. Clients should continue to consult licensed medical, clinical, or mental health providers for any medical, psychological, or clinical concerns.

3. Eligibility

Our services are available to individuals 18 years of age or older, wherever we are able to lawfully provide them. Because our founder is based in Portugal and we may serve clients located in the European Union, additional data protection rights and mechanisms, including those required under the GDPR, apply to EU-based clients; we are in the process of implementing the formal mechanisms needed to fully support international clients as we expand. If you are unsure whether we can currently serve you, please reach out via our website contact form before booking.

4. Booking, Payment & Cancellation

  • Full payment is due before the first session for all offers. Sunshower Collective does not offer payment plans.

  • Please provide at least 24 hours' notice to reschedule or cancel a session.

  • Across a full 10-session flagship arc, clients receive one no-penalty late cancellation or no-show; subsequent late cancellations count as a used session.

  • Packages and programs are non-refundable once Services have been used. You may request a full refund within seven (7) days of purchase, provided that no sessions have been used and no program materials, recordings, templates, or deliverables have been accessed or downloaded. Outside this window, fees are non-refundable, though Sunshower Collective may, at its sole discretion, offer a partial refund or credit toward future Services in exceptional circumstances; no such exception shall be required or considered a waiver of this policy.

  • Memberships (such as annual memberships), where offered, are paid in full for the applicable term in advance and are non-refundable, in whole or in part, once the term has commenced. Memberships renew automatically unless you provide written cancellation notice at least thirty (30) days before the renewal date; your access continues through the end of the current paid term regardless of when you cancel.

  • If you participate in a group, cohort, or community program, you agree to keep confidential any personal or business information shared by other participants and not to disclose it outside the group setting.

5. Intellectual Property

All content on the Sunshower Collective website, including text, graphics, logos, and session materials, is the property of Sunshower Collective, LLC unless otherwise noted, and may not be reproduced without permission.

6. No Guarantee of Outcomes

Coaching and consulting outcomes depend on many factors outside our control, including client effort and circumstances. Sunshower Collective makes no guarantees regarding specific results.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Sunshower Collective, LLC, its founder, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of, or inability to use, the Services, whether based on warranty, contract, tort, or any other legal theory, even if Sunshower Collective has been advised of the possibility of such damages.

In no event shall Sunshower Collective's total aggregate liability arising out of or relating to these Terms or the Services exceed the total amount paid by the client to Sunshower Collective for the specific engagement giving rise to the claim in the twelve (12) months preceding the event giving rise to liability.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

8. Governing Law

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law principles, regardless of the founder's country of residence. Any dispute arising under these Terms shall first be addressed through good-faith informal negotiation between the parties; if unresolved, either party may pursue available legal remedies in a court of competent jurisdiction located in Illinois.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
